For any individual willing to access our website and avail its various services, the concerned individual must first agree and accept to the terms and conditions set forth by Flat Services which is a legally binding document between the individual and Flat Services. If any individual does not agree to the terms and conditions set forth, refrain from using our company portal.

Definitions

The term “Individual” includes anyone (Buyer/Seller/Property Owner) who is a legal citizen of India over the age of 18 years that allows access to the website with an email id, and a password which is either allotted to the individual or chosen by the concerned individual who will be solely responsible for this information to gain access and make use of the various interactive features in the website.

Website Access

To get a hold of all the services offered by, the visitor has to accurately fill a registration form in the sign up section with details such as name, email, mobile number and password. Post which a mail and an SMS with an OPT will be sent to the registered email id and number provided to confirm the visitors’ registration and account. The individual will be solely responsible for managing all activities, including safe keeping of their username and password to access their account.

Flats Services does not monitor the content any individual uploads on their respective profiles. Kindly contact a company representative if you see any profane content, nudity, deceiving pictures, racial speech, violent or harassing content or any other objectionable content. We do not take any responsibility for any kind of content uploaded and encourage you to help us keep www.flatsservices.com a safe and clean platform.

From time to time, shall communicate with the individual through various emails which include the verification mail, welcome mail, offers, and other informative content relating to the new features offered by tips, suggestions and much more. It does not own any inventory and does not validate or guarantee the contents in these offers, thus shall not be responsible whatsoever with the transactions conducted thereof.

The website uses the various services and features available in Google Maps. It does not guarantee the integrity of the contents, location, accuracy, or quality of the content.

Any individual wanting to post any real estate for the purpose of selling should be registered with MAHARERA. It will not be liable for any damages caused / misrepresentation or any wrongdoing. Individuals who are buying / selling property through verifying all the details including right, ownership etc. on their own.

Flats Services allows property owners registered on the website to post details, pictures, offers etc. regarding their inventory. The posting may or may not go live on the website and is at the discretion of the representatives after they have scrutinized the details thoroughly and consider the details to be appropriate post which the listing can be shared, downloaded and used by individuals as they deem fit. It reserves the right to advertise these listings as per their discretion, but does not guarantee the authenticity of the contents of these listings, offers and other details associated whatsoever and shall not be held responsible for any damages, loss etc., of any kind between the two transacting parties. Posting properties is absolutely free and no such fee is charged whatsoever.

Offers

This is a special offer advertised for a stipulated period to time. It does not guarantee the authenticity or the integrity of the listings advertised during that period and will not be liable for any damages / inaccurate details of the property listed or any wrong doing whatsoever. Individuals who are buying / selling or renting property through Flatsservices during the offer period must verify all the details on their own.

Charges

There is no fee or hidden charge during registration.
There is no fee or hidden charge for property owners to post on the website.
There is no fee or hidden charge to schedule a visit.
It reserves the right to charge a commission of 1 % from the client and 2 % from the developer on outright deals depending on the ratio of every amount.
For rental agreements, our company reserves the right to charge 1 month brokerage for every 2 years from the buyer and seller respectively.
Since www.flatsservices.com does not own any inventory listed on the website, we shall not be held responsible for any damages/loss caused during the transaction and the parties shall be solely responsible. Our company is only offering broking services.

Inaccurate Information and Omission

At times there maybe information on the site which could be inaccurate, could have typographical errors, errors in description, pricing, promotions or offers and availability, we reserve the right to modify, update information, cancel orders or change any information in the website at their own discretion without any prior intimation, including after you have submitted your order.

Intellectual Property Rights

Download, use, misuse of any intellectual property by any individual for any activities is strictly prohibited and any violation or misuse of this intellectual property will be considered a serious offense under the prevailing laws of India and the account shall be terminated without any notice. We as a company respect the Intellectual Property Rights of others and will continue to adhere to all applicable laws in India.

Prohibited Actions

The individual will be solely responsible for any activities taking place from their registered account and shall not divulge the details of the registered account to any other person to avail the services of Flatsservices.
The registered individual shall not attempt to gain unauthorized access to any information apart from that is intended to them.
The individual shall not attempt to store or send any virus / Trojan horse / bugs or other harmful computer code, files scripts or programs, “deep-link “, robot, spider, “page-scrape” etc.
The individual should not attempt to infringe any intellectual property belonging to any other person/party.
The individual shall not attempt to modify, change, tamper, copy, distribute or download content material or any form (written, images, sound, seller reviews and product reviews) on any other system for the purpose of commercial gains.
The individual shall not post / upload any content deemed as racial, harassment, explicit content whatsoever. In such cases, Flats Services reserves the right to delete such material without any intimation.

The individual is prohibited from uploading or sharing information which belongs to another person / party to which the individual has no access to threatening the unity, integrity, security and functionality of India whatsoever.
The individual undertakes to use the various services offered by our property company for lawful purposes only and any violation of these above terms will lead to termination of the said individual’s account without any intimation.
Flats Services does not take responsibility nor will be held liable for any disputes between 2 transacting parties whatsoever.

From time to carryout system maintenance, upgradation, tests, modifications and any other system maintenance work, Flats Services will without prior warning disable or terminate the registered individuals access to Flats Services at any point of time without any excuse at its absolute discretion. Flats Services will not be responsible for any loss, damages or expenses that the individual may have suffered and no fees or charges will be payable to the individual from the company as a result of the deactivation or in-access.

Use of Information

The individual agrees and authorizes that we have the right to:

All intellectual property, copyright material, listings and other information made available / contributed by the individual, remains the sole and exclusive property of www.flatsservices.com and the said individual cannot claim any of the above. If the individual during the term of the Agreement or after, the individual makes use of such material or any sort of intellectual property in any other website, it will be in direct violation of the terms and will be considered infringement of intellectual copyrights. In such a case, we have the right to take legal action against the individual under the applicable Indian Laws.
Use the data provided by the individual during the registration to send promotional offers, pass on this information to select third party companies and other associated companies to improve services, advertising purposes and to contact / communicate with you about other services, offers via email, telephonic call, sms or through any other communication mode irrespective if the said individual is on (National Do Not Call Registry) NDNC list or any other such database and undertakes that the registered individual will not make any complaints to NDNC for any calls, sms or emails received from our website regarding their services / offers/ products and shall indemnify the associate / associates for engaging in such practice. If the individual does not wish to receive any promotional offers, the individual can choose not to submit their number / email id or any other contact information.
Advertise, post, upload, share, list any property recommended by / or on behalf of another third party individual / builder / developers or broker or the office bearers of our company without prior intimation/knowledge/permission of the property owner/owners and as such the owner /owners of the said property shall not hold our company liable for damages, loss caused to either of the transacting party.

Flats Services uses the services of third-party companies to advertise on various World Wide Web sites or resources to reach out to prospective buyers, sellers and property owners and the data collected is used exclusively for this purpose. The company however reserves the right to give access to such data to their clients for the sole purpose of buying and selling properties only.

Retention of any data provided by the individual whether active on the platform or terminated / suspended. The data will be stored in the official records of Flatsservices for all eternity.
Store data and information provided by the individual such as email id and phone number and also consents that this data can be passed on to other select partners, vendors, select third party firms for the purpose of sending promotional material.

Arbitration

Should any dispute arise between the transacting parties out of the use of the website or thereafter, in connection with damages caused, misrepresentation, breach of contract etc., the dispute shall be referred to a sole Arbitrator who shall be an independent and neutral third party. The final decision of the dispute shall be taken by the Arbitrator and shall be binding on both parties. The arbitration shall be held in Mumbai and the proceedings will be governed under the Arbitration and Conciliation Act, 1996.

Indemnification

Any unauthorized use or misuse of any sort of information on the website will violate copyright laws, trademark laws, privacy laws and other applicable laws, statutes and its rules and regulations. You will be solely responsible for any activities conducted through your profile using your user name and password.
